At Sharifi Firm, our Los Angeles personal injury lawyers are committed to helping victims throughout Southern California pursue compensation. Our firm handles cases arising out of all types of accidents, including motor vehicle collisions, nursing home negligence, slip and fall accidents, and wrongful death. Forms of compensation that may be available in these cases include medical bills, lost income, lost earning capacity, property damage, mental anguish, loss of enjoyment, and pain and suffering.
Motor Vehicle Accidents
Motor vehicle accidents are usually a result of negligence in connection with cars, motorcycles, trucks, and recreational vehicles. We also handle cases involving airlines, bicycles, boats, pedestrians, taxis, and trains. To establish the elements of a motor vehicle collision case in California, you need to show the defendant’s duty toward you, the defendant’s breach of duty, actual and proximate (legal) causation, and damages. For example, if a truck driver violated federal hours of service rules, this would be a breach of the duty to use reasonable care behind the wheel. The trucker and possibly the trucker’s employer would be responsible for any injuries that resulted from the driver’s reckless actions.
Premises Liability
In California, property owners have a duty to keep their premises in good repair for visitors or provide warnings about dangerous conditions. If you are hurt in a slip and fall accident or because of a dangerous property condition, you typically can bring a premises liability lawsuit against the property owner or occupier. You will need to establish that the defendant occupied or controlled the premises where you were hurt, the defendant negligently used or maintained the premises, this negligence was a substantial factor in your injuries, and you suffered actual damages. A property owner may be considered negligent if it knew or should have known about a dangerous condition but failed to repair it or provide adequate warnings to visitors. The longer a dangerous condition exists on a property, the more likely it is a property owner should have inspected the premises and learned of its existence.
Nursing Home Abuse
Many nursing home abuse cases are brought under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA). In order to obtain a remedy under EADACPA, you will need to establish by clear and convincing evidence that a nursing home is liable for neglect, physical abuse, or fiduciary abuse and that it acted recklessly, with oppression, with fraud, or with malice in committing the abuse or neglect. Neglect may involve a failure to help a nursing home resident with personal hygiene and medical matters as well as a failure to protect a resident from safety hazards.
Wrongful Death
Wrongful death in California is defined as a death that occurs as a result of someone else’s negligence or wrongful act. The victim’s survivors or a personal representative of the victim’s estate may bring a wrongful death lawsuit in civil court to seek damages. A victim’s surviving spouse, domestic partner, children, or heirs, or certain people who were financially dependent on the victim, may be able to bring the lawsuit. You may bring a claim even if the person responsible for your loved one’s death was acquitted in a criminal trial. A higher standard of proof applies to a criminal homicide case, so a defendant could escape a conviction in a criminal trial but still be held financially responsible for damages in a civil wrongful death case.
